Public Interest Of House-Removing In Administrative Aspect

Recent years, house-removing is becoming a hot spot in social of China. Many contradictions have been turning up continuously of which the most controversial problem is the legitimacy of house-removing. This article considers that the nature of house-removing in city is condemnation of private property of citizen and house-removing can only be implemented on the basis of public interest by government. Taking this as the basic point, this article makes a detailed exposition of the intention and judgment standard of public interest, the difference of public interest and private interest and other problems be related by comparative method, economic method, demonstrative method, theoretic and systematic method. The author hopes that this article can supply a new and feasible way for lawmaking of house-removing in the future, and get a balanceable interest between regulating administrative powers, protecting citizen's rights and advancing house-removing for public interest and make justice and efficiency both be valued in practice.
