Research On Open Price Contract In International Sales Of Goods

With the development of international trade, a new kind contract—open price contract has come forth. The open price contract doesn't fix the price at the time of the conclusion. The appearance of open price term contract has brought great challenges to the traditional contract law. Therefore making a research on the open price contract in the international sales of goods has great contribution to both the theory and the practice of contract law.Based on introducing the definition and kind of open price contract, the first part of this thesis will expound its origin and background. In the second part, combined with both the national and international legislation on open price contract, the thesis will make a particular analysis on the formation of open price contract from the aspect of the legal theory of contract law. In the third part, by the means of comparative analysis, the thesis will pay more attention to the determination of price of the open price contract. The final part will make a discussion on the related principles of our country's contract law. As to satisfy the need of the rapid development of international trade, the thesis make some suggestions on how to perfect our contract law.
