On Duty Crimes In The Engineering Construction Field Of Our Country

In recent years, the issue of duty crimes in the engineering construction field is becoming serious day by day. The field has become one of the eight key fields of our country to carry on the precautionary work of duty crimes. Therefore, it is of great practical significance to study duty crime phenomena in the engineering construction field, to analyze its production reasons, to discuss the essential countermeasures of preventing and cracking down this kind of duty crimes.The duty crimes in the engineering construction field have the remarkable characteristics of carrying on"authority-money transaction"universally, committing many major and serious cases, adopting the hiding methods of committing crimes, having obvious intergrowth nature and the important link of committing crimes is inviting and offering bids.The crime reasons include individual and social reasons. After analyzing individual reasons briefly, the author analyzes the social reasons of duty crimes in this field with emphasis. First, the administrating system has the flaw of existing many loopholes but having little supervision, so lets someone have the opportunities. Second, the high quota construction profit lures the disorderly competition, and the construction dealers tempt the public service personnel who have the low income to commit duty crimes. Third, the investigation and management of illegal criminality is insufficient, it causes some people dare to defy the law.In view of the above reasons, the article proposes three big precautionary countermeasures emphatically. The first countermeasure is to strengthen the mechanism of surveillance and restrict, enable the public service personnel not to commit duty crimes through the measures of reforming the management system of engineering construction, perfecting the system of inviting and offering bids, strengthening the management of construction market, supervising the behavior of public service personnel comprehensively. The second countermeasure is to establish the benefit guidance mechanism, to cause the public service personnel do not want to commit duty crimes through the approaches of improving the treatment of the public service personnel gradually and establishing the mechanism of honest government rewards and punishment. The third countermeasure is to cause the public service personnel dare not to commit the duty crime through revising the relevant laws and regulations, investigating the behaviors of breaking laws and regulations promptly, and increasing the detection and punishment force.
