Study On Duty Crime In Construction Engineering

Since the reform and opening up, with China’s sustained and rapid economic growth,the rapid development of the construction industry, the expanding of engineering construction scale,and the national large scale investment in infrastructure construction,construction market is showing a thriving scene. However,as the large investment number of construction projects, long construction period, complex approval process,and nonstrict supervision, there provides trade for money and power. Duty crime in construction engineering is now the the harder-hit area of duty crimes. Fight against duty crime in construction engineering is related to people’s livelihood and social stability. Deep research of duty crime in construction engineering not only can improve the research system of China’s criminal law, but also maintain the health of the socialist market economic order through the guarantee function of criminal law.The author will use the method of comparative study to analysis the characteristics and causes of duty crime in construction engineering and search prevention and system construction of duty crime in construction engineering. This paper is divided into four parts. The first part is an overview of duty crime in construction engineering. First we introduce the concept of crime, duty crime, and construction engineering and summarize the definition of duty crime in construction engineering. Then we analysis the current situation of duty crime in construction engineering and summarize the periods and characteristics of duty crime construction engineering. The second part is the subjective and objective causes of duty crime in construction engineering. First is the illegal construction industry competition becoming fierce. Second is the lack of law crackdown. Third is the long period and multi stages of construction engineering and the difficulty of monitoring. Forth is low political quality and moral quality of some national staff. Fifth is law-abiding consciousness of practitioners. The third part is the introduction of the overseas experience of prevention of duty crime in construction engineering. We introduce the system and practice from Singapore, Germany, the United States and Hongkong on the prevention of duty crime in construction engineering. The fourth part is about the prevention and punishment strategy of duty crime in construction engineering in China. We put forward corresponding suggestions to the duty crime prevention and punishment of duty crime in construction engineering in China from building of construction engineering market, crime punishment strategy,market regulatory system, the ideological and political education and psychological counseling and strengthening the right restriction...
