Death penalty is a sensitive subject since it is directly related to human life. It is also of theoretical and practice significance since it reflects the value of life. Among those scholars who have argued on it and left us with instructive thoughts, some are defenders of death penalty based on the theory of retribution, and some are critics. The theory of retribution has a long history and is still vitally alive because this theory provides the foundation for the establishment and abolishment of death penalty. The justification of its existence lies in that it has evolved from"tit for tit, tat for tat"to the opposition of"non-punishment for the guilty","punishment for the innocent","severe punishment for minor commitment"and"lenient punishment for serious commitment". Advocates for death penalty believes that that a person deserves death for whom he kills is a instinct of human's revenge. Human's instinct of revenge will not be satisfied and justice will not be realized due to the abolishment of death penalty. On the contrary, death penalty abolishment advocates believe that death penalty is not the necessary way to punish the committer and there are some other punishments to execute revenge. Besides, they argue that once a mistake is made, the innocent will be punished, which is the breach of the principle that punishment can only be executed on the one who commits the crime.This article will elaborates the necessity of death penalty'exist from the Perspective of retribution. The first chapter will explain what is Retribution, retribution'taking shape course and the meanings of retribution in contemporary age. In the second chapter we will know establishment and abolishment of death penalty'main views. In the third chapter we call in question of the establishment of death penalty. In the last chapter analyze the death penalty'present condition of our country and give suggestions to perfect the death penalty system of our country from the Perspective of Retribution...
