Since the time of reform and opening, tourism becomes to be an important part in the modern people's lives and it also has already become a new growth of our national economy. The tourism industry is nicely called" the sunny industry of the 21 century".At the same time, in the recent years, although, in order to achieve the fast and healthy development of the tourism industry, the speed of the laws of the profession in our nation is high, and there are a series of the profession laws which have received good results have passed, annually .For the whole, the lawmaking is still far behind the development of the profession. The disunified related laws and the protection doctrines of the regions, usually resulted in conflicting and irregulate phenomenons in practices .So ,in the end, not only the rights of the tourists are more or less be denied, but also the benefits of the enterprises of tourism are also be cut. That is of cause because of the basic reason of the lack of a nationwide law of the profession.By the basic principles of freedom, equal and fair in civil law, this thesis draws lessons from the past and lawmaking examples of the other countries and regions. And there are the author's viewpoints of the definition and contents of the rights and obligations of the travel contract and the responsibilities of the travel agency.This thesis is consisted of the preface ,four chapters and the conclusion.The first part, preface. This part involves various concept problems related with travel contract, including the definition of tourism, the concept of the law of travel, the recent development of the tourism industry and its present conditions of the law of the profession.
