With the maturity of the travel and the extension of the market scale in our country, our legal system is being perfected and our residents' consciousness of law is strengthening, travel disputes, especially the disputes concerning travel contracts, are also increasing greatly. In our country the travel contract is becoming more and more important, in the same time there is no specialized travel contract lawmaking up to now. According to the above, the author studies some related systems of tour contract and put forward rational suggestions.The dissertation is entitled "Study on Travel Contracts". It consists of four parts apart from introduction.Part I: The nature and standardization of travel contracts. The author defined the concept of the travel contract, studied the nature of travel contracts on the base of the classification and put forward the problem of the standardization of travel contracts.Part II: The effect of travel contracts. It includes the right and the duty of both parties of travel contracts, tourists and travel agencies. On the other hand in the organized travel contract sometimes the third party is involved, the author thinks that the property of it is an implement to complete the duty, when the third party infringes the rights of tourists, the tourists should bring a lawsuit against travel agencies.Part III: The liabilities for breach of travel contracts and immaterial compensation. According to the traditional civil law, immaterial compensation is only regarded as of relief measures resulted.from tort, not applied in the cases of violating contracts. However, with the development of society, the article holds that immaterial compensation system should be established in travel contracts so as to safeguard the lawful rights and interests of tourists effectively.The Conclusion Part: Suggestions about the travel contract lawmaking in our country.
