The equality is considered the foundation of the state power, while the right of equality is one of the basic rights of human beings. Safeguard of equality is not only the necessary requirement of democracy, but also the principal spirit of the society dominated by law. China's present goal is to set our socialist country under the rule of law, however, in the overwhelming majority of national population, farmer's right of equality is the hardest to achieve. This article describes the realization of Chinese farmer's right of equality in the political, the economical and the social aspect in the present situation, analyzes the cause to this formation, provides some idea of solution accordingly, aims at more care to the farmers as well as the realization of their right of equality.This article started from a death compensation case occurred in a traffic accident in Beijing. The different compensation standard between the citizens and farmers makes the transportation troublemaker lucky, and the farmer cannot obtain the equal protection from law. Along with this case, we fall in ponders of right of equality. Afterwards, this article generally introduced related theory on right of equality, emphasizing on the idea of equality, the formation of right of equality, modern concept of right of equality and the safeguard of right of equality in China, etc, to make the essential theory for the following elaboration.Accordingly, this article has carried on the question concerning the comprehensive description of the Chinese farmer's right of equality.
