According to the design of the government, the goal of the reform of collective enterprise is to set up the modern enterprise system of "perspicuous property right, definite right and responsibility, government and enterprise separated, as well as scientific managing". Anyhow, the government does not show the detailed path of how to implement the reform of the modern enterprise, especially of how to make clear of the property right of the collective enterprise. In practice of reform, various modes of reforming appear in different places. But, all these groping modes did not solve the core question of how to make clear of the property right. Academically, much research on this question is concentrated on the field of economy, and few articles are made with a view to juristic theory. Furthermore, to those few articles made by implementing juristic theory, they explore the possibilities of "perspicuous property right" only in the field of juristic practice. This article is attempted to carry through the research of the reform of the collective enterprise with the use of the knowledge and theory of political economy and economics with an eye to law. I wish the article be of use for reference to the reform of the enterprise.The article is divided into 4 chapters.Chapter One is about the analysis of the theories of the collective economy and collective enterprise in socialist countries. In this chapter through the juristic analysis of the collective enterprise, collective economy and other related concepts, it makes a summary of that the collective ownership is neither the communion nor private possession in law.
