Inquisition by Torture, as a valid way to obtain the oral confession from suspected offenders by the national judicial department, was admitted to be legitimate. With the progress of society and the development of human civilization, Inquisition by torture, which is regarded as full of harm, received criticism from reality together with punishment by law, and forbidden all over the world. However, Inquisition by Torture is not easy to be banned in judicial practices.As a life lives in the modern era which pays attention to the protection of human rights, yet a people researching on law, feels more worry to this phenomenon. Though there has been numerous personages carrying on a thorough research to this problem, I still choose it as my thesis. Because I believe, as long as inquisition by torture didn't disappear quietly from the judicial practice, it is necessary to be concerned about.The thesis is divided into three chapters besides introduction and conclusion: In chapter I, the author makes a summary of the purpose and its necessity about inquisition in criminal procedure. It not only be of benefit to crack a criminal case, but also do better to protect the suspected offender's legal rights.
