The Analysis Of Inquisition By Torture Based On Legal Psychology

Inquisition by torture appears in all ages in China. With the quickening of the socialism ruled by law of our country, yet inquisition by torture hasn’t adapted our socialist legal request. Criminal Law of PRC has explicitly formulated that it is strictly prohibited to take actions for torture in order to obtain criminal suspects and defendants’ confession, inquisition by torture behavior still exists in practical trial. The inquisition by torture behavior has badly damaged the physical and psychological health of criminal suspects and defendants, has badly damaged the fair image of our country’s judicial organs. This paper trys to analyse formation reasons of the inquisition by torture behavior from the angle of Legal Psychology, then the paper will search measures to solve the problems, so these measures will achieve the purposes of holding back the inquisition by torture behavior and creating a civilized and legal society.The paper takes Qualitative Methods and Quantitative Methods, major research method is Qualitative Methods, assistant research method is Quantitative Methods. The main innovative point is that it is basing on fundamental theory of Legal Psychology, synthesizing relevant knowledge of Psychology, systematically expounding the formation reasons of the inquisition by torture from the angle of external environment and internal factors. Then the paper puts forward measures basing on the formation reasons of the inquisition by torture behavior, all the measures are multi-pronged to exterminate the inquisition by torture behavior finally.
