The admissibility rules of electronic evidence are adoption of standards regulated by law on evidence entering into the proceeding and other process of proof,and legal requirement which electronic evidence is adopted in the proceeding by judges.Information collected for activities of procedural witness,which are giving full play to proving legal fact,must accord with adoption of standards regulated by law and admissibility judgment by judges.Relating to content of admissibility rules of electronic evidence,there are considerable differences in every nation of correlation legislate and the judicature in the world.But legislation of electronic evidence between two legal systems suggest that,actual association and legal effectiveness are the problem to be solved by admissibility rules of electronic evidence.Legislation of electronic evidence in the countries of Civil Law System mainly regulate evidence-obtaining rules but none in admissibility rules.Anglo-American law system countries regulate admissibility rules in detail,and also regulate legality and authenticity of electronic evidence generally.After comparative analysis of admissibility rules among Anglo-American law system, UN Model Law and Civil Law System,the author considers to use foreign successful practice for reference to build perfect admissibility rules of electronic evidence of our country,and boldly design rules of our country based on P.R.C.Model Law on E-commerce law.
