On The Legal Protection Of Personal Information In China

Personal information, which is owned by natural person, could identify its owner. It's an important resource in the information society. It provides info for government's decision-making and brings benefits to corporations, at the same time it is the object of personal consumption. The development of science and technology makes it easy to collect and use personal information, and also makes it easy to infract it. The legal protection of personal information becomes one of the pressing legislative plans. The author tries to analyze the basic nomology and the main problems of the protection of personal information, and tries to bring forward a legislative draft by comparing to the foreign legislative modes.This paper contains four parts. Part one points out the essential problems of personal information such as the definition, the characteristic, the attribute, and the content. Part two analyzes the actuality of the personal information protection in China, and points out its causation and significance. Part three probes that the basis of the personal information protection is the need to protect personal rights and freeness which from the private right, and considers that the limits of the personal information protection conclude the public interest, the other's interest and self-consent. Part four compares the foreign legislative modes, points out which mode we should adopt, and brings forward the legislative suggestion.
