In today’s society, along with the development of information technology and internet technology, personal information processing technology is increasingly sophisticated and powerful, which makes people’s lives, trading, public management and other aspects more and more convenient and efficient. At the same time, the security of personal information is under attack by kinds of institutions. Learning from the experiences of other countries in this issue, the legislation of personal information protection is urgently needed. This article is divided into five parts to discuss about the legal issues of protection of personal information.The first chapter is an introduction which reviews the historical development of the personal information processing technology and the lack of personal information protecting legislation in China, and points out the urgency of today’s personal information protection issues. The second chapter defines the concepts of personal information and analyzes some closely-related concepts, emphasizes the features and the legal nature of personal information, discusses the social demand of the legislations and the difficulties during the legislative process; The third part discusses the conflict and balance of interest on Personal Information Protection and comes to the legislative purpose, then discuss the basic principles of personal Information protection base on the OECD Guidelines, analyzes the right of the owner of personal information. Chapter forth According to the status of China’s personal information protection legislation, foreign legislation of our puts forward the legislative suggestions of the protection mode of personal information, the regulatory authority, the judicial relief, as well as cross-border information flow policy. The fifth chapter makes a conclusion that China should establish Personal Information Protection Act as soon as possible to protect individual rights and advance developing and utilizing information resources.
