The institution of the third party derives from the system of civil litigation. As international commercial transactions becoming more intricate, the disputes submitted to arbitration always involves the third party of non-party to arbitration agreement as well. Up to now, there are many controversial arguments on whether the institution of the third party should exist in the system of arbitration, and no consent comes out. The problem of the third party comes from the practice of arbitration and should keep development to fit its changes and needs escaping from being abandoned by the parts of commercial transactions.
