Although the international commercial arbitration is in the process of continuousdevelopment and improvement, it still faces the momentous challenges with the constantincrease of complicated commercial disputes. As a focus point, how to resolve such issueswith new prospective brought the institution of the third party into practice.This dissertation has discussed the institution of the third party both in theoretical andpractical field. It provides detailed analysis on the rationality and feasibility of the institutionof the third party regarding various arbitration theories, and further sets up some practicalprocedures in operation based on fully consideration on provisions and rules of some nationsor famous arbitration organizations.This paper compromises four chapters. Chapter One deals with the concept of the thirdparty, by comparing the difference between various definitions; Chapter Two explains therationality and feasibility of the institution of the third party from theoretical perspective;Chapter Three enumerates some provisions of nations and rules of famous arbitrationorganizations and sum them up into a chart; Chapter Four mainly focuses on setting up apractical framework in operation, including the procedure in applying, recognizing, choosingthe arbitrators and enforcement of adjudication.
