Protection Systems Of The Economic Law On The Economic Liberty

Economic Liberty is not noly an important spirit of market economy but also an important principle of Economic law. Economic Liberty means that under the permission of law,all parts in the market economy have the rights to do economy business with their wills,such as the freedom of investment,management,competition,consumption and work. The spirit of Economic Liberty is impenetrating through all the fields of the Economic law,and is realized by the Economic law to define the rights and obligations of the main body in the market.In recent years,the principle of Economic law was embodied frequently in the practice of our legislation.For example,our new corporation law has debased the thresholds to set up corporations,our new securities law has opened more fields in the activities capital markets.These are the proofs of our big progress in the protection on the Economic Liberty.But we also should pay attention to the hedges of the Economic Liberty. Particularly monopoly is the biggest problem.How to sovle these problems is the first thing to do for our Economic law.So this article has an important significance on theory and practice.This article takes several methods to rearch such as historic method,theory related practice method,demonstration and criterion method.So this article summarizes the history of the thoughts on the Economic Liberty in the west countries and China,conbines the actual practice of the two.Firstly,this article introduced the the history of the thoughts on the Economic Liberty,and the conception,value of it.Scecondly, this article expatiated the relationship between the Economic Law and the Economic Liberty.Thirdly, this article pointed out the progress of the Economic Law on the protection of the Economic Liberty,and the pointed out the shortage at present.Finally, this article gives some suggestions on the problems,such as the legislation of the antimonopoly law, the interfering of the government and the relief of the judicatory.
