Study On The Lost Property Finding System

The lost property finding system belongs to the ownership system of the Real Right Law. The provisions of our present law about the lost property finding system are principle and simple, can't meet to the require of our practice. Take advantage of formulating the Real Right Law and the Civil Law of our country, establishing a specific lost property finding system is quite necessary. But what value orientation should our lost property finding system choose ,what contents should it includes, and how should we assign the rights and duties that the finders have, these problems are still disputing. In the base of our Real Right Law(draft) and two the Expert Proposals, the author elaborates the concept of finding the lost property, then introduces the general situation of this field abroad and comparing them. The third part is the key part , here the author analyzes existing regulations of the lost finding system, raise the rights and duties that finders should have and it's safeguard. In the last part, the author comment the bona fide acquisition and advertisement offering a reward. Hope that our lost property finding system will be more rational, perfect and precise in the future.
