Lost Property Picked Up System Research

It is inevitable to lose the belongings when people are creating wealth. With therapid development of social economy and intensify between people and physicaldistribution, the possibility of losing personal finance is surprisingly increasing,therefore, the whole society pays more attention on FLPM (finding of lost propertymechanism). Through doing researches on basis theoretical knowledge of lost propertyand the investigation of foreign laws about FLPM, this paper analyzes suchshortcomings below of FLPM in our country: no rules show the reward request right ofthe loser, so that the rights and obligations between the loser and the finder areunbalanced seriously. That all the lost-and-found objects failed to be claimed belong tothe state does no good for their efficiency utilities and it may waste the social resources.No rules show that bona fide acquisition comes into effect for finding of lost propertybehaviors; in order to intensify market transaction high-risks, which is unfavorable forprotecting the legitimate rights and interests of the third person. Consequently, throughborrowing ideas of foreign laws, this paper provides specific suggestions toconsummate the FLPM (finding of lost property mechanism) of our country, consistingof establishing the reward request right of lost property, confirming that bona fideacquisition comes into effect for kind behaviors and getting lost property ownership oncertain condition and looking forward to perfect lost property picked up system in ourcountry.
