Research On Legal System For Biosafety

There are many different definitions on biosafety theoretically.On the basis of all these definitions,the author adopted the broad sense,and defined biosafety as the safe status in which the ecosystem and human beings can be prevented from the biosafety problems such as the negative effect of biotech and the invasion of exotic species.This definition has two meanings.First,the safety of the biotech is the core of biosafety.Second,problems such as the invasion of exotic species are also classified as biosafety problems which can threat the ecosystem and human beings. Biosatefy is a crucial part of ecological security,but it is more uncertain and more dangerous.And since it is a new problem compared with other ecological problems,few people have heard about it.However,there are many disadvantages in China's legal system in biosafety including low legislation level,unperfect system,lack of harmonious system of law enforcement,and people's weak consciousness of biosafety. So,strengthening China's legal system in biosafety is indispensable.Meanwhile,the research in biosafety is mostly done by biologists and ecologists instead of jurists which means China's research on legal system in biosafety cannot be adapted to the demands of practices.The author hoped that this thesis could be helpful to China's legal system in biosafety and lead to more research on that.Except for the introduction and conclusion,this thesis consists of three parts:Part one is the outline of legal system in biosafety. In this part,the author introduced the origin and development of the definition of biosafety and gave his own definition;considering biosafety as an important constituent of ecological security and legal system in biosafety as an important constituent of legal system in ecological security,the author explaint the essential strategic meaning and deep practical meaning of legal system in biosafety.Part two is the research on biosafety legislation.This part is divided into two sections including the legislation of biotech safety and exotic species which are typical in biosafety legislation.In the first section,the author outlined the biotech and its safety problems,analyzed international legislation,found out the weakness of China's legislation,and suggested on a perfect biotech safety legislation which included legislation aim,principles,and contents.The author utilized the same method to research on the legislation on exotic species in the second section.Part three is the research on biosafety law enforcement. In this part,the author took the law enforcement on biotech safety and exotic species as examples,and through the discussion of the present situation of China's law enforcement on biosafety,the author put forward his own ideas on advancing China's law enforcement on biosafety.Based on the former parts,the author concluded that with the development of science and technology,and the advancement of the society,a lot of new biosafety problems and the harm of current biosafety problems would appear in the future.In order to minimize the harm of biosafety problems,the best way is to pursue legal system in biosafey,make consummate biosafety-related laws,observe principles of cautious development and protection of public security,and build uniform and concerted law enforcement systems conprising early-warning system and urgency-dealing system.Legal system in biosafety is not to stop the development of science and technology and the advancement of society,but to make them more continuable.Legal system in biosafety is not to meet troubles half-way,but to prepare for foul in fair weather.
