Study On The Legislation Of Land Use Planning

Land is the foundation of human living and development, and also is the basic element to found the nation, and bring peace and orders to it. The land use planning is the basic creed of the reasonable development, the utilization, the renovation and the protection of the land resource, is the important method of the land resource optimization disposition, is the important guarantee for promoting the social economy sustainable development, is the prerequisite of scientific management of national land resources, is the important gist by which all levels of people's government and their land administration department supervise and minister the conducts of land development, utilization and protection according to law. China is the country with large population but little quantity of land, especially lack of cultivated land. With the development of the urbanization and industrialization, the contradiction between the supply and the demand of land has been quickened; meanwhile, the problem for soil erosion and land degradation rises seriously. In order to solve these problems, the government has modified the overall plans of land utilization several times, but not in good effect. Because the current land use planning law is not perfect, causing the extent of the plan implementation not high, the aim of the plan can't be realized. Taking cultivated land tenure quantity as the example, by the end of 2004, in more than 20 provinces it had already broken through the target of 2010. No law, no administration. As one of the government functions, the land use planning is closely connected with the plan legislation. Therefore, it is necessary to speed up the land use planning legislation to safeguard the land use planning implementation and to promote land resource sustainable use.Based on the above background, this thesis retrospect our country land use planning legislation evolution, analyzes the question which exists in the current our country land use planning legislative work, and demonstrates our country land utilization plan legislation necessity and feasibility.
