The Research On The Legal System Of Proprietors' Autonomy In Property Management

The property management is the inevitable production when the real estate market develops to a certain level. Along with the deeper reform of housing system, the better housing quality and synthesis services are requested by public. At the same time, the problems about houses come out more and more. The property management becomes hot complaints by consumers. And the society pays much more attentions. It would relate each person's vital interest.This article is written for the purpose of discussing the related system, development and existence problems in this field. We mainly take the proprietors' autonomy as the core, offer a few commonplace remarks by way of introduction so that others may come up with valuable opinions, and discuss the legal system construction of proprietors' autonomy in China. The whole thesis consists of three parts. First part is an introduction about present property management in China, in order to draw out the subject. We also briefly introduce the object and significance of this subject, as well as the idea and methods during study.The second part consists of five chapters. Chapter one: "the outline of proprietors' autonomy", introduces some related definitions first, as well as proprietors' autonomous right foundation and principle significance, focuses on the second section about legal foundation of "proprietors' autonomy". Chapter two: "proprietors' autonomy organization", introduces the proprietors' autonomy organization, related processing patterns and defect involved. Theory arguments and the practice confusions are discussed in a judicial worker's position. For example, "research of proprietors' legal status" in third section is written for the purpose of constructing and supplying the subject basing on analyzing our cases. Chapter three: "proprietors'pledge" , is very important content beside proprietors' autonomy. Basing on the rules of proprietors' autonomous right exertion, we discuss the setting, inuring of proprietors' pledge, standard the general content of proprietors' pledge. Then I discuss the effect of proprietor's pledge to make it as the basis of proprietors' autonomy. Chapter four: "the legal relationship and legal duties of proprietors' autonomy". We clear off the proprietors' autonomous internal relations and the structure by legal theory, which is advantageous in further discussions and investigations of the proprietors' autonomy construction and consummation. Chapter five: "Chinese present proprietors' autonomous system self-criticism and reconstruction". This is our research subject. We attempt to find the problems, solve the problems, straighten out the legal relationships in proprietors' autonomy after analyzing the present autonomous system, set up the suitable proprietors' autonomy organizations, and provide some advices in constructing a proprietors' autonomy legal system applicable in China's particular situation.The conclusion summarizes the core questions of this article, simultaneously points out other fields unable to touch, and establishes the direction with emphasis for the next research.
