Owners To Manage The Organization Legal Status

Since the reformation and opening of China, the process of urbanization and housing construction has made a big advancement. More and more residents have obtained private housing assets by purchasing commercial real estate and lived in"community", and the possession of buildings has become regular. Simultaneously, with the reinforcement of the awareness of autonomy by residents, the general meeting of proprietors and committee of proprietors have appeared and developed at a great speed. However, as the result of the flaws in the legislation system, the theory of the proprietorship of buildings has been delayed and the theory of realty management is still immature. So the disciplines on the legal status of managerial organization of proprietors are incomplete, thus influencing the exertion of its function and leading to many problems in the practice of realty management. On one hand, the identification of the representative subject of proprietors'lawsuit has not achieved agreement among the courts. On the other hand, the relationships, rights and obligations between the managerial organization of proprietors and its internal frameworks are obscure. Accordingly, this paper focused on the issues mentioned above and investigated on the legal status of the managerial organization of proprietors in reference to the legislation examples at abroad and existing problems at home.The whole article is spread in three chapters. In the first chapter, the legislation cases about the managerial organization of proprietors were investigated. In Section One, the formation of managerial organization of proprietors was introduced, and the"ternary theory"was deduced under the analysis of the conception of proprietorship of buildings. In Section Two, the samples were taken in French, Germany, Japan, USA, Singapore, HongKong, Macao and Taiwan to compare the legislations on managerial organization of proprietors. Then we may land...
