Legislation Concept Of Water Environment Control Research In Chinese Cities

In this essay, the author thinks from the perspective of system, there are many problems in the legislation on water environmental management, such as the barrier, absence and failure of system and the absence of pertinent system, etc. Improving the system could not be achieved only by transplanting system in a simple way or by revising the law. Furthermore, the improved system does not mean the maximum social benefits and the efficient compliance with the system. So it is necessary to improve the law of water environmental management in an extensive way and in different aspects. Anyway, it is very important to explore the legislative conceptions on water environmental management.Through the previous researches on legislation and the practices of water environmental management, the author puts forward that much emphasis has been made on the counter-measurements, but analysis on concept of water environmental management legislation has been neglected. In order to seek the system basis and theoretical foundation, the author analyses the practice of law of water environmental management in American and Japan and points out the various and common points. It has been concluded that emphasis has been given to the public interest, the cost benefit analysis and the public participation in the legislation. By comparing the case of water environmental management and legislation in different cities like Shanghai, Chongqing and Qingdao, weakness has been pointed out and the basic ideas of forming the conception of water environmental management and legislation in China have been put forward as follows: building the conception of legislation on Chinese water environmental management with public interest as the standard, the cost benefit analysis as the evaluation reference, the public participation as the direction. In order to prove the above idea, the author discusses on the water affair franchising system, which is the important choice in the transition period of conception on the water environmental management legislation.
