Legal Countermeasures Research On Anti-theft Of Trade Secrets

In recent years, as China's rapid economic integration into the global economy, the competition among enterprises was fiercely increased. Some commercial enterprises adopted various means to steal trade secrets for making illicit profits or displacing the opponent, seriously disrupting the order of the socialist market economy. Although China has initially established a system of Countermeasures against the theft of trade secrets, there are still many deficiencies in legislative, administrative, judicial and other areas, far from being able to meet the needs of the struggle against the theft of trade secrets. In current circumstances, to establish and perfect the anti-theft of trade secrets legal response system, such principles should be followed such as strict laws, well-conceived institution, the relentless punishment and a heavy responsibility. Meanwhile, attentions must be paid to further improving of the legislative framework, increasing anti-theft technology, cultivating employee's loyalty, improving the quality of judicial personnel, as well as increasing efforts to investigation and punishment of criminal cases.
