Lately, numerous group disputes for consumer interests and rights arise frequently. Though consumers can go to court for resolutions, since the limitations of the plaintiff-standing and group litigation systems, they have a great deal of difficulty in protecting consumer interests and rights. Diversely, there are perfect and mature plaintiff systems in group litigation to protect consumer interests and rights, due to the expanding of plaintiff-standing in foreign countries, esp. in German and America. Therefore, we shall expand the plaintiff-standing and improve the plaintiff systems in group litigation urgently, if we want to protect consumer interests and rights in group litigation efficiently. Firstly, establish plaintiff systems in group litigation for consumer interests and rights, from the view point of group status, rights, group litigation conditions and judgments effectiveness. Secondly, construct plaintiff systems in class action for consumer interests and rights, from the view point of the affirmation and modes of class, as well as test cases and consolidation litigations. Thirdly, go along with some reforms of match systems to ameliorate litigation environment for plaintiff, such as theamicus curiae providing amicus brief. Finally, set up some restrictions to the plaintiff, from the view point of the relationships among the plaintiff and defendant, lawyer, judger etc., so as to avoid the plaintiff abuses the group litigation systems.
