Research On The Well-Known Trademark And The Anti-Dilution Protection

Well-known trademarks refer to the marks that are widely known among relevant public and enjoy higher reputation in a national range. There is more and more invasion phenomenon to well-known trademarks in recent years because of it's tremendous value. It's not enough to protect well-known trademarks by the theory of confusion. The dilution theory can protect well-known trademarks better. The article analyses the deficiency of our protection for the well-known trademark and then gives some proposals to improve our legal system of well-known trademark dilution from the view of legislation.The article consists of four chapters.Chapter one is about discussion on the concept, characters, and the recognition of well-known trademark. Thus the necessity and importance to protect well-known trademarks is pointed out.Chapter two gives an interpretation on the protection theories for well-know trademark protection, including the theory of confusion, of association, of unjust enrichment, and of trademark dilution. On the base of the comparison of the four theories, the theory of trademark dilution is the most perfect theory for the protection of well-know trademark.
