Research On Anti-Circumvention In Antidumping

Anti-circumvention problem is one of the focuses in the field of today's international economics and trade. After practice for many years, EU and US anti-circumvention legislations have gradually developed well without regard of controversy. And GATT/WTO also tried to draw up united international anti-circumvention legal regulations. It, however, could not meet the need of antidumping practices, as China's existing anti-circumvention legislation has difficulty in keeping circumvention within limits. So it is necessary to improve the anti-circumvention in our country, after using the experience of foreign legislation and practice for reference.This paper is composed of four parts: Part one is fundamental theory of anti-circumvention. It offers us the concept of anti-circumvention and its kind as the outcome of extending of antidumping measure, then demonstrates its rationality and legality. Part two introduces separately and compares EU and US anti-circumvention legislations at the some aspects such as the way of definition,constitution,procedure of application. Additionally, the anti-circumvention provision in Dunkel Text is introduced to show the hope and efforts of the international community to make united international anti-circumvention regulations. In part three the author clears up Status Quo of the existing anti-circumvention legislations and practice in China. Part four expounds the necessity and feasibility of improving Chinese anti-circumvention system and then put forward some concrete suggestion in both substantial and procedural regulations.
