In recent years, industrial accidents repeatedly occur. Employees'security has become one of the hot topics of academic investigation. Most people focus on the subsequent supervision and inspection, as well as to industrial injury insurance and legal labor damages improvement. This article will discuss from two perspectives: security and efficiency, also combine with legislative and judicial practice to expose systematically the employees'security right. Advocating prior legal regulations is an important point of this article, so that we can establish a complete legal system to protect employees'security.In addition to the introduction, there are four parts in this article. The introduction explains the significance, the basic methods and ideas of this study. Chapter I is the legal characterization of employees'security issues, focusing on the right and value analysis, and points out that the legal system of employees'security should be strengthened. Chapter II examines the security issue of employees. Through case study and game theory, it analyzes the current confrontation and coordination between employees and manager. This part emphasizes appropriate intervention of state authority, so that we can intensify the implement of the security system. Chapter III introduces the history development process and specific approach of the legal security system in overseas countries. The experience shows a historic change from the neglect to emphasis on security protection, which can better control accidents. This conclusion is of great value for current decision-making on security issues. From the analysis of the current security status in China, Chapter IV puts forward some legal countermeasures, including the intervention of punitive damage system, the corporate social responsibility, the reformation of trade union organizations, as well as the improvement of the legal relief system. These methods all stress prior regulatory, from point to surface, in order to achieve security and efficiency eventually.
