Research On Illegal Possession

Illegal possession is a important legal term in criminal law ,but there are some divarications in theories and judicature .This article wants to explain the real meaning of illegal possession and some legislation about possession.The article analyses the meaning of illegal possession in terms of comparatively analysing,and trys to explain the legislation of possession,comparing to the meaning of possession in civil law.The article starts with the meaning of possession in civil law, analyses the difference of the meaning of possession between common law system and civil law system.Based on these ,analyses the difference between civil law and criminal law.At last, the article trys to explain whether the legislation of our country need the system of possession.There are four chapters except Preface and Conclusion.Each will be seperately summarized as following:Chapter1. In civil law,possession is not a kind of right,but a lawful reality.Chapter 2. As a legal term,the meaning of possession is different in civil law and criminal law.Chapter3. The chapter is mainly about the meaning and content of illegal possession,and explains whether"on purpose of illegal possession"is needed in legislation of criminal law.Chapter 4. The chapter mainly explains whether the system of possession is needed in lagislation and the author's advice.
