With the quick development of globalization in economy and S&T, international cooperation in science and technology (ICST) has increasingly come to be one of the most important forms of communication in which countries develop their S&T, economy and culture. Ownership issues of intellectual property (IP) are the key issues which influence the process of ICST, and also the easiest field to arouse disputes. Therefore, specifying IP ownership is of great significance to promote international S&T, economy and culture communication.This paper centers mainly on the ownership issues of IP in ICST. The whole paper includes five chapters, besides introduction and conclusion.The first chapter illustrates the basic legal framework of ICST. It first introduces the concept, legal forms, basic principles and development trends of ICST , and then analyses the status quo and countermeasures for further promoting ICST in China. The second chapter first introduces and comments on five traditional theories about IP ownership in ICST, and points out that the five traditional theories are in favor of developed countries. And it then puts forward four basic principles should be abided by for specifying IP ownership in ICST.The third chapter illustrates the legal practices of IP ownership in ICST according to the main forms of ICST.The fourth chapter analyses the disputes of IP ownership in ICST, illustrates the causes of the disputes and puts forward specific methods for disputes settlement.The last chapter introduces the development of IP ownership system in China's external cooperation in science and technology, points out the problems of the system and puts forward some advice for perfecting the system.
