Study On Legal Issues Of Bill Purchase Under L/C

This paper introduces the concepts and characteristics of Export Bill Purchase and Import Bill Advance under Letter of Credit, compares them with their related businesses, analyzes the law issues of them and the application of Trust Receipt in Import Bill Advance, combines the practices and relative cases of Export Bill Purchase and Import Bill Advance in China, and refers to the relative provisions of foreign laws, finally concluding the advices in improving Bill Purchase legislation in China and using Trust Receipts to avoiding Import Bill Advance risks.The whole paper is divided into six parts:The first part summarizes Export Bill Purchase and Import Bill Advance, introduces the concepts and characteristics of them and their comparison with their related businesses.The second part discusses the law issues in the practices of Letter of Credit Bill Purchase business, while combining the judicatory practices of Export Bill Purchase and Import Bill Advance, analyzes the law issues facing the business in existing Chinese laws and regulations.The third part introduces Trust Receipts in Letter of Credit Bill Purchase business. By introducing the concepts, emergence, development, properties and applications, the feasibility and existing problems in applying Trust Receipts to Import Bill Advance are analyzed.The fourth part analyzes the influence of existing foreign laws and regulations on Bill Purchase business and introduces the foreign courts' understanding of Chinese Bill Purchase business.The fifth part is providing the advices in improving Chinese laws and regulations of Letter of Credit Bill Purchase.The sixth part is the conclusion of this paper.
