With the development of economic globalization, different kinds of international transformation have become more and more frequent, especially in the rapid developing international maritime transportation market since 1980s. The changing of offering and requirement of maritime personnel is very distinctive to some extend in that market. The rising and development of economy is unconsciously changing the public's value judgments, resulting in great decline of numbers of seaman in developed countries. Under such background, the maritime personnel in developing countries is indicated to be more and more competitive and offered a great opportunity. With the help of self-contained law system and incorruptible administration, and resorting to their born predominance—English, Philippine exported the most seamen in the world.Our country is famous for richness of labor force in the word. Nowadays, the export of maritime personnel of our country has been legitimately approbated by IMO, but "Seaman Act" is still veiled. Only some relative regulations could be found in Maritime Law. So in our country, there are mass problems in aspects of legislation of seaman, administrative systems of exporting seamen and rights guarantee waiting for settlement.Aiming at solving above problems, this dissertation tries to analyze and compare relative legal systems, administrative systems and rights guarantees in Philippine with those in our country under methodologies of positivism, compare, and history analytical method. So that our problems and their roots could be unveiled, and then trying to put forward some legislative advices or amelioration adapting the satiation of our country and international tradition. I do really hope this dissertation could do some contributions to ensure the healthy, sequential development of our seamen personnel exporting market and to further explore its potential development.
