Research On The Procuratorial Organ's Prevention Of Official Crimes

Beginning with the meaning of official crimes, this paper analyses the concept and meaning of prevention of official crime, briefly introduces the prevention system about official crimes in our country, and explains the subject status of procuratorial organs in our prevention system.After theoretically analyzing our procuratorial organs' prevention of official crimes, the author points out that our procuratorial organs are the organs of supervision of national laws, analyses the relationship between procuratorial organs' prevention of official crimes and the right of supervision of laws and introduces three official advantages of the procuratorial organs' prevention of official crimes, such as high legal authority, high-quality human resources and successful experience.In order to draw on good experiences home and abroad and complete our procuratorial organs' prevention of official crime, the author discusses three important periods of the development of the ancient monitoring systems in China: the legal period, the close period and the complete period, and then analyzes the favorite experiences in the prevention of official crimes, and gives the summary and evaluation of its reasonableness.Then the author analyses the statuses of the prevention of official crimes of the foreign procuratorial organs and the other examination organs of official crimes and classifies them into three modes: the examination mode by the procuratorial organs (such as Japan and America ), the examination mode by the police organs(such as England ) and the examination mode by the independent specific organs (such as Singapore), and sums up their enlightenment experiences so as to hope them useful to our procuratorial organs' prevention of official crimes.In the last part, on reviewing the work of our procuratorial organs' prevention of official crimes and outlining their development, the author points out that the following questions lying in our procuratorial organs' prevention of official crimes: the procuratorial organs are subject to local governments and difficult to develop their independence, the legal system of prevention of official crimes needs completion, the level of examination of official crimes lags behind and the ideas of prevention needs reform. At last, to our procuratorial organs' prevention of official crimes, the author points out the thought of punishment after the event and the thought of prevention before the event in the circumstances of correctly handling the relationship between the procuratorial organs and the other preventive subjects. The thoughts are as follows: to raise the ability of the procuratorial organs' attack on the official crimes, to increase the international cooperation of punishment of official crimes, to raise the examination level of attack on official crimes, to endow them with special examination measures, strengthen the punishment of official crimes, increase the use of property and criminal punishment, and in the meanwhile, to fully develop the beforehand prevention function of the procuratorial organs, to complete the relative laws of prevention of official crimes , to realize the vertical management by and under the provincial government, to complete the protective and awarding systems for the informers, to strengthen the full supervision of the important construction projects ,to raise the professional ethics of public officials and to strengthen the warning education.
