With the expansion of industrialization, environmental pollution happens frequently. The accident contaminating brings extremely large loss for sufferers'person and property. According to the principle of the person who contaminates is responsible, contaminate person should undertake compensative responsibility. But pollution can not be avoided in modern production, even enterprise produces in the light of environmental protection standard, it may bring about damage to others. In such circumstances, it is unfair to ask contaminate person to undertake all responsibility. With the appearing of assigning justice and community responsibility, people hope realizing expectations which are compensation and scattering risk by insurance, so environmental impairment liability insurance develops quickly. The environmental impairment liability insurance can scatter risk, make the environmental indemnity responsibility of the enterprise share with society, avoid business enterprise bankruptcy for a huge sum of compensation, at the same time, give the victim relief quickly and effectively. At present, many polluted accidents happen in our country, but the theories and practices about the system of environmental impairment liability insurance are not efficient in our country, so it is necessary to study and establish environmental impairment liability insurance system.At first, this thesis elaborates the connotation and characteristics of the environmental impairment liability insurance, then compare the environmental impairment liability insurance with environmental impairment compensative fund. Secondly, the paper analyses the function of this kind of insurance. Thirdly, the type and coverage of environmental impairment liability insurance are discussed. Many countries, especial developed countries has established system about the environmental impairment liability insurance, this paper introduces the theory and practice of environmental impairment liability insurance in other countries. By analyzing and comparing legislative model of environmental impairment liability insurance in other countries, we should establish environmental impairment liability insurance that is in line with state of our country. In accordance with the current in our country, some suggestions are made in this paper.
