| System of people's congresses is a fundamental politicalsystem of China. And strengthening power of legislation andsupervision is a requisite to ensure that people are the mastersof our country and to uphold system of people's congresses.However, in practice, the People's Congress always putemphasis to legislative power while neglect the power ofsupervision, which leads few thorough and systematic studieson the power of supervision and weak supervision in our society.This thesis aims to make a theoretical study on the supervisorypower of the People's Congress.In order to substantiate the validity, at the verybeginning, this paper processes its analysis from suchperspectives as concept defining, intrinsic rules, externalcharacteristics and so on. The supervisory power of thePeople's Congress converted by people's rights embodies themodel "the right harnesses the power"; meantime, thesupervisory power of the People's Congress has the authorityof the state, which demonstrates the model "the powerharnesses the power". In addition, the effective acting of thesupervisory power and the efficient supervision to thesupervisory power should be ensured by laws, so we need "thelaw harnesses the power" The second chapter provides asystematic illustration of law's regulation on thesupervisory power of the People's Congress. And Chapter threebrings forward some feasible suggestions to the incomplete lawsystem on the supervisory power of the People's Congress inChina. The supervisory power of the People's Congress is tosupervise and restrain the state power to prevent abuse of thestate power. There are three models in both theory and practiceto prevent abuse of the state power, including the rightsharnesses the power, the power harnesses the power and the lawharnesses the power. Previous studies always discuss thesuperiority of one of the three models. In this thesis, theauthor holds an opinion that the supervisory power of thePeople's Congress covers all the three models.
