Study On The Supervision Power Of The Supervisory Committee

The 18 th National Congress of the Communist Party of China proposed to improve the power operation restriction and supervision system,and promote the theoretical construction and practical exploration of the power supervision mechanism with Chinese characteristics.Subsequently,the supervision pilot work was passed,and the reform of the supervision system was the launched nationwide.Through the supervision and checks and balances of power,the negative attributes of power were reduced,and the occurrence of corruption was reduced.The Supervisory Committee exercises the supervisory power conferred by the Supervision Law,governs corruption,and regards supervision as the primary productive force against corruption.In this context,this article studies and discusses the supervisory power of the supervisory committee to understand the legal basis behind the reform of the supervisory system in China and the significance of the supervisory power of the supervisory committee.This article is divided into five parts to study the supervisory power of supervisory commission.The first part starts from the theoretical basis of the right of supervision,analyzes the operation status of the right of supervision,and draws the conclusion that the reform of supervision system meets the needs of reality.The source of the supervisory power of the supervisory commission and the new development path are discussed.The second part is a theoretical analysis of the basic connotation of the supervisory commission’s right of supervision.Through the analysis of its definition,object of supervision,function orientation and nature,the power connotation of the supervisory commission’s right of supervision is improved.The third part is about the operation mode of the supervisory commission’s supervisory power,the necessity of the office,the specific mode of the supervisory commission’s exercising the supervisory power and the problems it should pay attention to,as well as the legal effect of the supervisory commission’s exercising the supervisory power.The fourth part is through to the supervisory board to supervise the summary analysis of the theory and practice,the supervisory board to supervise the limits of power of supervision object is not clear,lead to public power boundary is not clear,supervision does not reach the designated position caused by insufficient supervision efficiency,and inspect the lack of regulations on the supervision process,supervision and feedback system is not perfect,the follow-up supervision strength is insufficient,the honest education work to carry out the daily work does not reach the designated position;On the fifth part is aimed at the problems proposed in this paper,the supervisory committee to supervise and carry out the further security,summed up the perfect the supervisory board to supervise operation suggestion,set up by the supervisory committee confirmed list of power system,strengthen the supervision committee supervision precise supervision,standard of form a complete set of laws,and to make supervision analysis mechanism,and strengthen the integrity in the daily work of education,improve the preventive supervision system.With a view to further make the supervisory commission’s supervisory power full play.
