A Study Of Local Legislation

Legislation is the foundation of running a country according to law and establishing a socialist legal state. Therefore, the 16th cession of CPC puts forward that legislation should be strengthened and the quality of legislation should be improved and a legal system with Chinese socialist characteristics should be formed in 2010 so as to adapt to the new situation of socialist market economy and China's accession to WTO. The legal system with Chinese socialist characteristics is a complete legal system which includes the constitution as its kernel, the laws as its main body and the administrative regulations, local regulations, regulations on the exercise of autonomy and separate regulations. The local regulations are important components of the legal system with Chinese socialist characteristics. As the organs of state power, the People's Congress Councils and their standing committees of the provinces and big cities shoulder heavy task of local legislation. The local legislation not only displays the local features but also accumulates experience for the national legislation so as to contribute to the forming of legal system with Chinese socialist characteristics. Therefore, the local legislation becomes more and more important.CPC is the only party in power in a country with a population of 1.3billion. The strategic task of establishing a harmonious socialist society put forward by CPC displays the requirement of the important thinking of"three represents", the requirement of scientific concept of development, the requirement of the reform and opening-up in the new era, the quality of CPC that seeks truth from facts and keeps pace with the time, the courage and wisdom of CPC in facing and solving the practical problems. The establishment of socialist harmonious society is related with the fundamental interest of the overwhelmingly majority of the people, the society foundation of consolidating CPC's position as the party in power, the whole picture of building up a well-off society in an all-round way and the prosperity of CPC's cause and the long-term stability of China. With the deepening of reform of administrative system in China, we have realized two historic changes. One is changing the traditional running a country only according to policy into running a country according to policy as well as law; the other is changing the traditional administrating a country only according to administrative means into administrating a country according to administrative means as well as law. The second change is a fundamental one. The important policy and measures adopted by the CPC and the central government for the reform and development should be changed into law and regulation so that they can be the code of conduct and standard of the whole society. The construction of socialist democratic politics and ethics should be protected by law and regulation. The local legislation is of great significance to guarantee the implementation of constitution and law and the important thinking of"three represents", to ensure the building up a harmonious society, to urge and ensure the reform and opening up in the local place and to maintain a coordinated and sustainable development of all kinds of social and economic undertakings.The author of this paper put forward the idea of local legislation according to his own practical work. Though the idea is not mature, it is helpful to strengthen the local legislation of Changchun city and create a new picture of Changchun's local legislation in accordance with the aspiration and will of the overwhelming majority of citizens of Changchun, in accordance with the requirement of running a country and a city according to law and in accordance with the objectives of revitalizing Changchun traditional industrial base and establishing a harmonious and prosperous Changchun city.
