Community Mediation

With the disorganization of "danwei" society and the formation of community system, various kinds of social problems converge into community which makes it the key point in dealing with interest conflicts. Challenged with this, how to seek the effective way to solve the problems in order to build a stable and harmonious society, have been a crucial issue for us. The communalization of social problems can be seen from many aspects, including the high frequency of civilian disputes, the diversification of people involving in disputes and its upgrading level, which calls for an effective mediation mechanism to tackle with.Along with the advancement of building a harmonious society, people from all circles begin to attach great importance to the stability of urban grassroots society, and make great efforts to perfect the community mediation system of civilian disputes, which is useful to form a pluralistic mediation mechanism that integrate with residents, community organizations and governments. However, for a long time, we pursued a "danwei" system in practice and thought that "danwei" be the main undertaker to mediate community civilian disputes, which make the community mediation system of civilian disputes totally imperfect.This paper chooses "community" as the microcosmic visual angle of the research, thinks civilian disputes mediation as the way out of social integration, proposes feasible suggestions to maintain the stability of urban grassroots society. Initially, the paper defines the concept of "community civilian disputes", and then summarizes its characteristics and cause of formation. The paper acknowledges that the community mediation system of civilian disputes include three forms, such as the people's mediation, administrative mediation and judicial mediation. The author discusses the function and operation mechanism of the three forms respectively and analyzes the situation in which they interact with each other. Though the system works well, we can not neglect its defects. The author analyzes the current problem existed in the system from the point of view of rationalizing the function border and puts forwards such countermeasures as disjoin the power border between the government and the community scientifically, change government function and advance residents self-government, perfect laws and rules to build scientific and effective mediation system of civilian disputes and maintain the stability of the community, which will allow the system into full play. In addition, it can benefit us a lot as to strengthen the integration of urban grassroots society and advance to build a harmonious society.
