At present, the group labor disputes become more and more concerned by all aspects of society, the so-called "group" as the name implies, refers to the number of personnel involved in the dispute, in a wide range. The current labor dispute resolution of our country is the main mode of mediation, the mediation fails to apply for arbitration, the arbitration is not satisfied with the results and then enter the proceedings the implementation of two instance. This pattern for both employers and employees have a wider choice, of course, mediation play an important role in this model. However, the labor dispute mediation mechanism in our country and there are some problems in the construction of thought in the process as well as the development background. So this paper will through the concept the group labor disputes, the characteristics of discourse analysis in China group labor disputes, and the idea of constructing group labor disputes constructive in the system.The first chapter is a brief overview of the group labor dispute mediation. This part mainly includes two sections, the first section introduces the origin and characteristics of the group labor disputes in the history, and the second section introduces the definition, theoretical and applicable scope of the community labor dispute mediation system.The second chapter mainly comments on the main problems existing in the settlement of the disputes in the community. The main problems of the mediation system in China is not perfect. The main role of the government is not prominent.The third chapter mainly expounds the labor dispute mediation system in the United States, France and Taiwan, and analyzes the advantages of the three countries (regions), such as:pay attention to the role of mediation in the labor dispute settlement mechanism, the establishment of labor dispute mediation professional institutions, the implementation of the three party principle, in order to make the future of China's system of reference.In the fourth chapter, according to the problems of the system of collective labor disputes mediation in China, the article gives some suggestions on the basis of the United States, France, Taiwan area of the advanced legal system and practical experience, with its own characteristics, which mainly includes: the improvement of the enterprise internal mediation system, the establishment of government as the mediation mechanism, the improvement of the judicial mediation system and grassroots mediation.
