The Studies Of Safeguard Measures Institution

Safeguard measures are among trade relieves of offered by World Trade Organization, which mean that a member can restrict imports of a product if such product is being imported into its territory in such increased quantities which cause serious injury or great threat to the counterpart domestic industry. The dissertation gives brief introduction to the general theories of WTO safeguard measures and its evolution in history. Consequently, safeguard measures are attached more and more importance by WTO member as a kind of powerful trade instrument, which contribute to relieve industrial injuries and equipoise trade interests. WTO Agreement on Safeguards establishes strict provisions for implementing and procedural conditions to guide the application of state members. And the dissertation stresses on the provisions for implementing and procedural conditions and other conditions during the operation of WTO safeguard measures with ready cases to show the positive effects of WTO safeguard measures in performance and the importance of further exploring the measures, which is the main purpose of the author.Some state members also formulate their own safeguard measures with the basis of the facts of each state member and WTO safeguard measures. The author makes a comparative study between the legislative growth and its provisions concerned of America and that of European Community by which we could find the weakness and complement the weak points of each other. In the process of comparative studies, the advanced theories of industrialized countries could be absorbed in our own system. This dissertation also introduce the special safeguard measures, which compared with general theories of WTO safeguard measures, base on this, we also provide some policies of special safeguard measures to face to other WTO members. The last but not least, the dissertation deals with the legislative growth of China's safeguard measures and makes a critical comment on the China's legislative system. And the author also proposes some measures to the problems existing after the China's entry into the WTO. We should upgrade the process of modernization on legislative system of China and perfect the Chinese safeguard measures system besides strictly comply with WTO regulations and the commitment that made by our government. At the same time, we must effectively make good use of safeguard measures system in order to protect the domestic industry and safeguard the econmic development of country. Therefore, the subject of this dissertation, i.e. safeguards, is of great significance.
