During the Two Sungs, trades of lands and houses are very active, especially the way of live-sale, which get a booming development in the period of Two Sungs. Based on people's practices and government's active administration, Live-sale was systemized gradually in Two Sungs, and the system made a profound influence to the future generations. This thesis will make a complete elaboration from the aspects of following: the development history of live-sale of lands and houses, the character and function of live-sale of lands and houses, the law concerning live-sale of lands and houses during Two Sungs, and the estimation of correlative law. This thesis also will make an exploratory thinking about the question, that is, whether we should abolish or still reserve and perfect the system of live-sale.When discussing the character of live-sale of lands and houses, this thesis attempts to look for a breakthrough in the methodology, which jumps out of the frame of just right level, but sets out from ancient people'real life. In this way, I try to study from the position of live-seller and live-buyer respectively to see what on earth live-sale meant to them, to see what kind of convenience (cheapness) on earth live-sale brought to them. Based on the research of ancient people's (take the people during Two Sungs for example) real viewpoint about live-sale, it comes out the real character of live-sale.When gathering the law concerning live-sale of lands and houses, this thesis quotes some cases to take into a deeper explanation, by which reflects the circumstances of obeying the law in real life, and make the article more convincing.Finally, this thesis makes an overall evaluation about the law system of live-sale of lands and houses, mainly point out the imperfections of the law system.This article is composed of three parts, that is , the introductory remarks, main body and summary.The introductory remarks point out the objective and importance of this article, and give a definition of"live-sale".The main body is composed of four sections. The first section gives an account of the history development of the live-sale system of lands and houses. The second section demonstrates the character of live-sale of lands and houses, in my opinion, its character is one pattern of sale with condition of buying back at the price of original. The third section completely gathers the law concerning live-sale of lands and houses during the Two Sungs, and gives a brief evaluation of the correlative law. The last section illustrates reasons about the booming development of live-sale in Two Sungs, and comes to a conclusion, that is, live-sale is losing market in nowadays.The part of summary briefly sums up the main opinions of this article.
