Legal Ponderation Over Recall System On Defective Products In China

As a mature and relatively perfect system, Product Recall System has long lasted in developed countries. With the publicity and implementation of Defective Vehicle Recall Control Regulations in 2004, Product Recall System started its practice in China. After consummating current vehicle recall system with its practice, the next step is to set up Product Recall System including all the products. This thesis includes four parts altogether.Part One: Discusses the theoretical basis of recall system and the basic concepts related to product recall are introduced and clarified through telling the differences with similar clauses. It is held in the. article that there are three main fetures about recall system: systematic management; adjusting in advance and public interests as purpose. Part Two: Through analyzing the practical significance of the construction of product recall in China, this article believes that it' s really necessary to set up such a system.Part Three:There are still many difficulties and obstacles to set up such a system in our country and some counter measures are given in this article.Part Four: Introduces the origin and development of Product Recall System in the developed countries of representativeness. It mainly focuses on American recall system and especially gives details to the procedure and characteristics of the recall of vehicle and common consumer goods. Then briefly introduces recall system in other countries,such as Australia, France and Japan and generalizes the enlightenment for China.Part Five:Points out some defaults and improvement about the law related product recall and the innovative ideas and suggestions are provided to the construction of Chinese Defective Product Recall System.In a word, the in-depth study and discussions are conducted and some advices are given in this article, with a view to improve the current regulations and better set up our product recall system as a whole in near future.
