Study On Defective Product Recall System

Defective product recall system has established and implemented in today's world, especially in developed countries. Practice has proved that Defective Product Recall System, for producers and sellers, played an important role in improving the consciousness of quality and integrity, encouraging enterprises to take the initiative to increase the investment of technical and environmental protection and Standardizing the market economic order. Our country has explored in Defective product recall system in a certain range, but till now we haven't built a sound legal system of it. Defective product recall system is so important that it can help safeguard the legitimate rights and interests of consumers, regulate the socialist market economic order and improve the competitiveness of China's enterprises in the international market. Therefore it has become a top priority to establish and improve China's defective product recall system by referring to the experience of developed countries and Combining with China's national conditions.Based on the regards of the experiences in developed countries, the author analyzes the current legislative status and problems in the Defective Product Recall System in our country and proposes some suggestion to make the recall system perfect in this dissertation. In addition to the preface and the epilogue parts, this dissertation is divided into four chapters.Chapter one is the introduction of the dissertation. With the fact that defects appear more and more and bring in serious injury to the society, it is necessary for China to learn from foreign countries since now China is facing big challenge in food securities. Furthermore, all these must be fulfilled to speed up the process of Regulations of recalling the defects.The second chapter introduces definitions and categories of defective product, defective product recalls system. By comparing the similar concept to enable more accurate.Chapter three is the theoretical basis of the defective product recall system. This part introduces the theoretical basis of the defective product recall system from the economics, sociology and law. Besides the introduction, this part analyzes the legal nature of the defective product recall system.Part Four Regulations of recalling the defects at home and abroad. According to analyze foreign regulations of recalling the defects i.e. USA, Australia, and Japan, the paper gave a summary which was to be a reference for China to set up similar regulations. It further drew up a picture of current situation and defections of Chinese regulations.Part Five Construction and Perfection of Chinese Regulations of Recalling the Defects. The paper analyzed from two perspectives: macroscopically, to give advice on how to construct regulations of recalling the defects; microscopically, to give suggestion on how to perfect present laws and regulations, and auxiliary institutions.
