Research On Legal Problems Of NVOCC

The concept of NVOCC was first put into practice by the US Federal Maritime Commission (FMC), and is widely used in international shipping. Recently years, with the rapid and remarkable advances of international shipping in China, this particular entity enters into the business of foreign trade transportation. The State Council promulgated Regulations of PRC on International Maritime Transportation (the Regulations) on December 11, 2001, and they became effective as of January 1, 2002.The Regulations define "Non-vessel operating Business" for the first time and stipulate strict access requirements and supervisory policies in China. Though the comparison and analyses of NVOCC in different countries, and based on the existing stipulations of NVOCC in china.The comparative study and demonstration analysis method is adopted in this article. Chapter 1 introduces the history and definition of NVOCC. Chapter 2 compares the NVOCC with freight forwarder, the actual carrier. In order to make the status of NVOCC, the author makes several tables to analyze it. Chapter 3 is about the legal liability of NVOCC. Chapter 4 The author studies the problems in the operating of NVOCC business of China, and makes some suggestions of resolutions to those problems, the author analyzes the security system, issuing of NVOCC bill of lading, lien of NVOCC business. And this dissertation also studies whether NVOCC can enjoy the limitation of liability and the author make a detailed analyses and gives some points of view on them.
