| The NVOCC is in the prosperous development with the international trade and international shipping. With the development, NVOCC is facing various kinds of risks. In the special circumstances of transports of goods by sea , these risks are tremendous for NVOCC to undertake. Nowadays, there are security, cash security and liability insurance to run the risks, in which the most effective is liability insurance. But the liability insurance of NVOCC hasn't been made in China for a long time. There are many reasons, during which the most important is that there are not a clear meaning, a clear legal status and clear responsibilities of NVOCC in the legal provisions of our country. This made people keep arguing about the meaning of NVOCC for a long time. So people couldn't research the liability insurance of NVOCC.Firstly, this thesis tries to make clear the true meaning of NVOCC on basis of introductions of the legal provisions of other countries and comparisons of the scholars' viewpoints in our country. Secondly, this article analyses the legal status and liabilities of NVOCC with the basic theories of CMC and other legal provisions. Thirdly, it analyses the necessities and possibilities to set up the system of the liability insurance of NVOCC in China. Fourthly, this article works out the clauses of the liability insurance of NVOCC on the reference of usual clauses of famous insurance companies in the world and. our country. Lastly, this thesis points out the problems existed and met in the legal provisions of NVOCC in China, also it proposes the legal ways to set up the system of liability insurance of NVOCC in China in the future. |
