Research On The Administration Does Not Be The Direct Mechanism

The supervising mechanism of administrative inefficiency is a hot and controversial question in the study of the administrative law in our country. The study of the supervising mechanism of administrative inefficiency is of great significance to the construction of a complete and scientific administrative behavior theoretic system, to the promotion of legal application of administration, and to the protection of human rights. The present thesis is aimed at, from the perspective of administrative inefficiency and the supervising mechanism of administrative inefficiency and their constructing elements, analyzing the existing problems in the present supervising mechanism of administrative inefficiency, and putting forward the constructive idea of establishing and perfecting the supervising mechanism of administrative inefficiency. In the light of the researching aims of the present thesis, this thesis is divided into six chapters, namely, they are: Chapter one: Introduction, In this chapter a systematic and comprehensive description is made about the concept, the constructing elements, and the criteria for the judging of administrative inefficiency. In chapter two the author gives his analysis of the construction of the supervising mechanism of administrative inefficiency. In chapter three the author gives his analysis of the supervising mechanism of administrative inefficiency and the corresponding existing problems and the causes. In chapter four the author makes a comparative study of the supervising mechanism of administrative inefficiency and the legislation between China and foreign countries in the hope of providing valuable experience or case for the perfecting of the supervising mechanism of our country. In chapter four the author puts forward the constructing idea of establishing and perfecting the supervising mechanism of administrative inefficiency.According to the existing problems related to the supervising mechanism of administrative inefficiency, it is suggested in the present thesis that measures like the standardization of administrative power, the stressing of procedural legislation, the constructing of the responsibility-in-charge administration system, the perfecting of the supervising of the administrative main body, and the enlarging the range of legal inspection of the administrative inefficiency should be taken to prevent and reduce the occurrence of the administrative inefficiency and perfect the supervising mechanism. In the end, the author takes advantage of an illustrative case to express the urgency of perfecting the supervising mechanism of administrative inefficiency.
