Judicial democratization is the most important content of the idea of judicature atmodem times. The countries in the world have made great effort to try to achieve judicialdemocratization. One of the most efficacious systems is the jury systems. The jurysystems include the jury institution of the common law system and the lay judge systemof the continental law system. Both systems have their advantages and weaknesses. Thepeople assessor system of our country had an important effect at first. Then with thedevelopment of our society the systems arise many problems in practice. Although thepromulgation of the "Decision of the Standing Committee of the National People'sCongress Regarding Perfecting the System of People's Assessors" has affect the peopleassessor system perfectly. But it seems not solve the essential problem. This thesis is thatthe exist of the people assessor system has an important immediate significance, and weshould improve it instead of giving it up. We should refer to the advanced experience,observe and study the typical jury systems of other countries. We should know theirhistory source, contrast their models. And we can analyze the problems and reasons ofthe people assessor system according to the judicial situation of our nation, and then wecan choose the varied people assessor system which fits our judicial circumstances well.
