Rational Analysis And Prevention On Legal Dispute Of Student Management In Universities

Legal dispute of student management in universities mainly manifests on the following aspects: student injuries, discipline punishment, degree conferring, schools'legal rights and interests impaired, charges and career direction. Based on legislative situation and manifestation of common legal dispute, this article attempts to elaborate the cause and prevention of legal dispute thoroughly through ethics, systems, and concepts combined with Marxism.More and more problems about student management are emerged with the development of higher education. Conventional concepts and management methods cannot be applied to the growth of higher education. Many causes lead to legal dispute. On the one hand, protection of student rights has been strengthened whereas lacking obligations and honesty; on the other hand, school administrators are short of knowledge of legislative management whilst disregarding student rights and proper procedure. From the point of judicial practice, more explanations about the validity of school regulations and rules will be asked after legal dispute happens. In practice, the university administrative rules interfere with law and legislation. The legislation of higher education experienced a considerable development, however, still needs to be improved and perfected.Dealing with the legal dispute properly between universities and students is supposed to adhere to principles of the subject standing, legislation, rationality and proper procedure. To prevent law dispute effectively, administration by legal person should be emphasized. Implementing principles of democracy, legislation and science is strongly encouraged for universities administration. It is essential and worthwhile to research on available law and regulations while learn from foreign advanced experience.This article defines legal dispute of student management in universities, analyses ways of legal dispute and causes, furthermore, gives a solution to prevent legal dispute, which has a profound theoretical and practical meaning for student legal rights, legislation of universities decision and promoting university management by law.
