The Law Perspective About Power Of Colleges And Universities Student Management In Our Country

With deepening of the process of running the country by law and enhancement of individual rights consciousness, and the law doesn't make clear regulation to legal status of higher learning and legal nexus between university and students, and university students management procedures are defective and other causes, thus it is inevitable to appear collision between power of student management of higher learning and rights of university students in the practice of university. It shows as collision among power of university management and students personal rights, property rights and other rights, and this led to frequent proceedings. How to coordinate their relationship by law has been put on agenda. The new student management regulation established new regulations about ruling universities by law and compelling regulations in protecting students'rights and enlarging sovereignty of universities. Based on defining the legal status and legal nexus between university and students, we should construct management system of university students through improving manage idea, basis, procedure and entity relieve system, and improving appeal system, hearing system, arbitrate system and so on are important routes among them.
